Privacy & Student Records

How FLAMA protects student records, the choices your family has each year, and how this website handles the information you send us.

Our Commitment to Student Privacy

FLAMA protects student education records in accordance with the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. §1232g and 34 C.F.R. Part 99, and applicable Texas law. This notice explains your rights, when information may be disclosed, and how to restrict release of directory information. It also covers student surveys and exams, and how this website handles the information you send us.

Education records are records directly related to a student and kept by FLAMA or by a party acting for FLAMA. They can include enrollment, academic, attendance, discipline, health and student-support records, subject to the definitions and exceptions in law.

Student-records custodian (Superintendent or designee)
Frank Liu Jr. Academy for Music & Arts
info@flama.org

Contact the custodian for record questions, access or correction requests, and directory-information choices. Please say what type of request you are making. FLAMA will verify your identity and authority before providing protected records. Do not send Social Security numbers, medical documents or other sensitive records by ordinary email; ask us for a secure way to provide them. We can provide a paper copy, language assistance, an accessible format or in-person delivery.

Annual Notice of Rights Under FERPA

FERPA gives parents rights concerning their child's education records. These rights transfer to a student who turns 18 or attends a postsecondary institution (an “eligible student”). A parent includes a natural parent, a guardian, or an individual acting as a parent in the absence of a parent or guardian. FLAMA recognizes the rights of either parent unless it has evidence of a court order, state law or other legally binding document that specifically limits those rights.

1. Inspect and review records

Send a written request to the student-records custodian identifying the records you want to see. FLAMA will tell you when and how you can review them. Access will be provided within a reasonable time, no later than 45 calendar days after FLAMA receives the request, and sooner when applicable law requires. Special-education records have additional access rights under the Individuals with Disabilities Education Act (IDEA).

You may ask for explanations of records. If circumstances effectively prevent you from inspecting records in person, FLAMA will provide copies or make other arrangements. FLAMA will not charge to search for or retrieve records, and will not charge for copies when the charge would effectively prevent access. FLAMA will not destroy records while a request to inspect them is pending.

2. Request a correction and a hearing

Write to the student-records custodian, identify the part of the record you believe is inaccurate, misleading or otherwise violates the student's privacy rights, and explain the change you want.

If FLAMA declines to change the record, it will tell you its decision and your right to a hearing, including how to request one. The hearing will be held before a person who has no direct interest in the outcome, and you will have a fair chance to present evidence. FLAMA will give you a written decision explaining its reasons. If the record is not changed after the hearing, you may add a statement to the record explaining your disagreement. FLAMA will keep that statement with the disputed record and disclose it whenever it discloses that part of the record.

3. Consent to disclosure, with lawful exceptions

FLAMA generally must obtain your signed and dated written consent before disclosing personally identifiable information from education records. The consent must identify the records, the purpose, and the recipient or class of recipients. Electronic consent must meet FERPA's requirements for identification and approval.

FERPA allows certain disclosures without prior consent. One exception is disclosure to school officials with legitimate educational interests:

  • A school official may be a FLAMA administrator, teacher, support employee or board member whose duties require access to the records.
  • A contractor, consultant, volunteer or other outside party may be a school official only when performing a service FLAMA would otherwise use its own employees for, under FLAMA's direct control over use and maintenance of the records, and subject to FERPA's limits on use and re-disclosure.
  • A school official has a legitimate educational interest when the official needs particular records to fulfill a professional responsibility for FLAMA. Access is limited to the records needed for that responsibility; employment or a vendor relationship alone does not authorize access to all records.

Other exceptions include disclosures to officials of another school where the student seeks or intends to enroll, or is already enrolled, for purposes related to enrollment or transfer; authorized audit or evaluation officials; qualifying research organizations; appropriate parties in a health or safety emergency; and disclosures required by a lawful subpoena or court order. Each exception has conditions FLAMA must meet. FLAMA forwards records on request to a school where a student seeks or intends to enroll, as FERPA permits; parents may request a copy and a chance to challenge its content.

Directory information may also be disclosed under the separate notice below. Opting out of directory information does not prevent disclosures that FERPA authorizes under another exception. You may inspect FLAMA's record of disclosures where FERPA requires FLAMA to keep one.

4. File a federal complaint

You may file a complaint about an alleged FERPA violation with the U.S. Department of Education's Student Privacy Policy Office. A complaint must generally be filed within 180 days of the alleged violation, or of when you knew or reasonably should have known of it. Contacting FLAMA first is encouraged but not required.

Annual Directory-Information Notice

Directory information is information in an education record that generally would not be considered harmful or an invasion of privacy if disclosed. Designating it as directory information does not mean it is published online. It means it may be disclosed without further consent after you receive this notice and have a chance to object.

Directory-information categories

FLAMA designates only these five categories as directory information:

  1. Student's name.
  2. Grade level.
  3. Honors and awards received.
  4. Participation in officially recognized school activities, including music, arts and school performances.
  5. School years or terms of attendance, such as “2027–2028,” excluding daily attendance records.

Unless you object or the law restricts it, this information may appear in school publications and recognition materials, and may be released to people who follow lawful procedures for requesting directory information. Public disclosure can make information available beyond FLAMA families.

FLAMA does not designate home addresses, phone numbers, email addresses, dates or places of birth, Social Security numbers, student ID numbers, grades, test scores, discipline records, disability or health information, or daily attendance as directory information. Student photographs, video or audio recordings, and identifiable student work are also not directory information. Using them for publicity requires separate permission or another legal basis; this notice does not authorize it.

Your choices and deadline

You may object to release of all directory information or of any of the five categories. Use the form below, or send a written objection naming the student and the categories to withhold to info@flama.org, addressed to the student-records custodian. A FLAMA form is not required; a clear written objection is enough. Paper delivery is available on request.

You have 15 calendar days after you receive this notice to respond. FLAMA will not make any directory-information disclosure about a student until that period has ended and the family's choices have been entered.

You may also opt out or change your choices later in the year; the change applies to disclosures after FLAMA receives and verifies it. FLAMA cannot undo a lawful disclosure already made. A restriction stays in effect until you change it in writing, including after the student leaves FLAMA. A new annual notice does not cancel an existing restriction.

An objection may keep a student's name out of yearbooks, recognition lists or performance programs. You can separately allow a limited school use, such as the yearbook or concert programs, in Part B of the form. These choices do not affect admission, enrollment, services or participation in school activities, and they do not prevent necessary classroom use of a student's name or disclosures FERPA allows despite an objection.

Certain information about FLAMA students is considered directory information and will be released to anyone who follows the procedures for requesting the information unless the parent or guardian objects to the release of the directory information about the student. If you do not want Frank Liu Jr. Academy for Music & Arts (FLAMA) to disclose directory information from your child's education records without your prior written consent, you must notify FLAMA in writing within 15 calendar days after you receive this notice. FLAMA has designated the following information as directory information: student's name; grade level; honors and awards received; participation in officially recognized school activities; and school years or terms of attendance, excluding daily attendance records.

Directory-Information Opt-Out and Limited-Permission Form

Download the printable form (PDF) ↓

School year: 2027–2028
Student's name · Grade · Parent/guardian or eligible student's name · Relationship to student · Optional email or phone for confirmation

Part A — Objection to directory-information release

Choose one. An unchecked or unsigned form is not an opt-out; any existing restriction stays in effect.

  • ☐ I object to release of all five directory-information categories without my prior written consent.
  • ☐ I object to release of only the categories checked below without my prior written consent:
☐ Student's name · ☐ Grade level · ☐ Honors and awards received · ☐ Participation in officially recognized school activities · ☐ School years or terms of attendance

Part B — Optional permission for limited school use

Complete only if you want to allow a limited use despite your objection above. Leaving it blank grants no permission. I authorize FLAMA staff and its contracted publication providers to use only my child's name and grade level for the use(s) checked below during 2027–2028:

  • ☐ The FLAMA yearbook, distributed to FLAMA students, families and staff.
  • ☐ FLAMA music and arts performance programs, distributed to attendees, including members of the public.

This permission does not cover photographs, recordings, websites, social media, advertising or any other release. Information allowed only for this purpose otherwise stays confidential. You may withdraw this permission in writing for future uses.

Part C — Military recruiters and colleges (secondary students only)

Federal law requires schools receiving certain federal education funds to give a secondary student's name, address and phone number to military recruiters or institutions of higher education on request, unless a parent or eligible student objects in writing. This does not apply to FLAMA's kindergarten and first-grade students. If it applies to your student:

  • ☐ Do not release this information to military recruiters without my prior written consent.
  • ☐ Do not release this information to institutions of higher education without my prior written consent.

Sign and date the form and return it to info@flama.org, addressed to the student-records custodian, or ask us for paper delivery. Use one form per student. Do not include a Social Security number, date of birth or student ID; FLAMA will verify your authority using information already in its records.

Student Surveys, Exams and Marketing (PPRA)

The Protection of Pupil Rights Amendment (PPRA), 20 U.S.C. §1232h and 34 C.F.R. Part 98, gives parents these rights:

Consent before a student is required to take a survey funded in whole or in part by the U.S. Department of Education that asks about any of these protected areas:

  1. Political affiliations or beliefs of the student or the student's parent.
  2. Mental or psychological problems of the student or the student's family.
  3. Sex behavior or attitudes.
  4. Illegal, anti-social, self-incriminating or demeaning behavior.
  5. Critical appraisals of others with whom the student has close family relationships.
  6. Legally recognized privileged relationships, such as with lawyers, doctors or ministers.
  7. Religious practices, affiliations or beliefs of the student or parents.
  8. Income, other than as required by law to determine program eligibility.

Notice and a chance to opt your child out of:

  • Any other survey asking about the protected areas above, however it is funded.
  • Any non-emergency, invasive physical exam or screening required as a condition of attendance, given by the school and not necessary to protect the student's immediate health and safety. Hearing, vision and scoliosis screenings, and exams permitted or required by state law, are excluded.
  • Activities that collect, disclose or use personal information from students for marketing or to sell or otherwise distribute it to others. This does not include educational products or services.

Inspection, on request and before use, of protected-information surveys, instruments used to collect personal information for marketing, and instructional materials used as part of the curriculum.

FLAMA will notify parents at the start of each school year, and after any substantive change, of the specific or approximate dates of these activities, and will give parents a chance to opt out. FLAMA's policies on these rights are available on request. Complaints may be filed with the Student Privacy Policy Office at the address above.

This Website and Online Forms

What we collect

  • Volunteer sign-up: your name, email, phone number if you give it, how you would like to help, and your preferred language.
  • Enrollment information requests, applications and event tickets: these forms are provided by Cariina, FLAMA's enrollment and events platform. Information you submit there is used to answer your request, process your application, run the lottery and manage events. Cariina's own terms also apply.
  • Email: anything you send to info@flama.org.

How we use it

Only to respond to you, coordinate volunteers, and handle enrollment and events. FLAMA does not sell or rent your information and does not use it for advertising. Access is limited to staff and service providers who need it for those purposes.

Cookies and tracking

This website does not use advertising or analytics cookies and does not track you across other websites. To deliver the site, our website host (Webflow) and service providers (Google Fonts, and Cloudflare spam protection on forms) receive standard technical information such as your IP address and browser type.

Children

This website is meant for parents and the public. FLAMA does not knowingly collect personal information online directly from children under 13; parents and guardians apply on a child's behalf.

Your choices

You may ask to see, correct or delete information you sent through this website by writing to info@flama.org. Some records must be kept under Texas records-retention law, and once a child enrolls, their records are education records handled under the FERPA notice above.

Other websites

Links to other sites, such as Cariina, Instagram, Facebook and Google Maps, are governed by those sites' own privacy policies.

Applications and Public-Information Requests

Information from inquiries and applications is used only to process them and is never published under the directory-information notice.

As a Texas public charter school, FLAMA is subject to the Texas Public Information Act. FLAMA reviews requests under Texas law together with FERPA and other confidentiality rules; a public-information request does not override student-record protections.
